日本の難民認定手続き－改善への提言

日本の難民認定における問題点を考察し、それを改善していくための解決策を提示する。難民手続きを知るうえで格好の１冊であり、国内の難民問題に関心のある専門家や学生は必読！

Chapter 1では、日本が長年にわたり「難民鎖国」を行ってきた背景、難民認定手続導入への道のり、そして、難民条約の入管政策への影響についてをまとめている。ここでは、1970年代のインドシナ難民の事例をあげ、それが難民保護法制の整備をもたらした歴史を紹介している。Chapter 2は、難民認定の諸問題に焦点を当て、特に、難民概念の曖昧さ、情報収集の欠落、コミュニケーションの難しさ、濫用防止策の陥穽の四つが、難民認定手続きを困難にしている理由としてあげている。Chapter3は、難民認定機関と認定処分の性質を、難民手続き設置時の議論を通して詳細に説明している。Chapter 4は、申請から認定までのプロセスの実態を法的な視点から分析し、そこで生じる問題点を明らかにしている。Chapter 5では、基本的視角を提示し、それをふまえ、不透明な難民認定手続きを改善するための六つの提言を行っている。
